Simon Penney Waste Consulting
28 September 2026

These Terms govern use of the website at https://www.simonpenneywasteconsulting.co.uk/ and any related website operated by Simon Penney Waste Consulting (the “Website”). Please read them before using the Website. If you do not agree, please stop using it.

1. Who operates this Website

The Website is operated by Simon Penney, trading as Simon Penney Waste Consulting (“SPWC”, “we”, “us”). SPWC is a business registered in Ontario, Canada (business identification number 1001727764). Contact: simonpenneywasteconsulting@gmail.com. Business postal address: [1039 Simmons Rd, Ontario, K0H 2H0]. SPWC provides services internationally; references to a UK audience or UK projects do not by themselves mean that SPWC is incorporated in the UK or maintains a UK establishment.

2. Information, not instructions for action

The Website provides general information about waste management, circular economy, Extended Producer Responsibility, environmental policy, business development, training, technology and related subjects. Material may be simplified, dated, based on assumptions, or inapplicable to a particular jurisdiction, facility, waste stream or project. References to laws, technical standards, costs, savings, emissions, market size, commercial outcomes or performance are indicative unless expressly stated otherwise. We may correct or remove content without notice and do not undertake to keep every page current.

Website content, including complimentary preliminary reviews, examples, downloadable materials and replies to general enquiries, is not a site-specific risk assessment, engineering design, legal or regulatory opinion, financial or investment advice, health and safety instruction, product certification, or a recommendation to acquire or deploy a particular technology. Do not rely on it to determine legal compliance, handle hazardous or healthcare waste, protect health or the environment, make investments, procure equipment, or implement a project. Obtain appropriately qualified professional advice and verify current local requirements before acting. You remain responsible for decisions and actions you take using information from the Website.

3. Services and separate agreements

Descriptions of consulting, mentoring, speaking, education, training, study tours and travel-related support are invitations to enquire, not binding offers or guarantees of availability, scope, price, outcome, placement, visa approval or travel arrangements. An enquiry, meeting booking, application or submission does not create a client relationship or duty to provide professional services. Paid services arise only when the parties expressly agree to a separate written proposal, engagement letter or contract. That agreement controls the scope, fees, allocation of responsibility, insurance, liability and dispute process for those services; these Website Terms do not replace or reduce any obligations in that agreement. Tour and travel arrangements may also be subject to organiser, supplier and booking terms supplied at the relevant time.

We may work with independent associates or introduce third-party providers. Unless a signed agreement says otherwise, a reference, introduction or link is not an endorsement, warranty, agency relationship or assurance of suitability. You must carry out your own due diligence.

4. Permitted use and intellectual property

You may view and print reasonable extracts for your own internal, non-commercial evaluation, keeping notices intact. The Website and original text, graphics, branding and other materials belong to SPWC or its licensors and are protected by applicable intellectual property laws. You may not republish, sell, scrape at scale, modify or present our content as your own, or use our name or marks to suggest endorsement, without written permission. Rights in third-party material remain with its owners.

You must not misuse the Website, attempt unauthorised access, introduce malware, interfere with its operation, or use it unlawfully. We may restrict access where reasonably necessary to protect the Website, others or our rights.

5. Submissions and communications

Information you send through a form or email should be accurate and lawful to share. Do not send confidential, commercially sensitive or special-category personal information through a general enquiry form unless we have agreed an appropriate secure method. Sending information does not oblige us to accept a project or maintain it in confidence beyond obligations imposed by applicable law or an express written agreement. We will handle personal information in accordance with our separate Privacy Notice. You remain responsible for keeping copies of material you submit.

6. Availability, security and external links

We take reasonable care in operating the Website, but do not promise uninterrupted access, freedom from errors or malicious code, or compatibility with every device. Use your own appropriate security precautions. Third-party websites and tools, including booking platforms, are governed by their own terms and privacy practices. We do not control their content, availability or security.

7. Warranties and limits of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence where that restriction is prohibited, fraud or fraudulent misrepresentation, and non-excludable statutory or consumer rights. No clause requires a consumer to give up a mandatory remedy.

To the fullest extent permitted by applicable law, the Website and its general content are provided “as is” and “as available”, without promises that information is complete, accurate, up to date, suitable for your circumstances or capable of producing a particular result. Subject to the preceding paragraph, SPWC excludes implied warranties or conditions to the extent the law permits.

Where the user is acting in the course of a business, and to the extent reasonable and permitted by law, SPWC is not liable for loss arising from reliance on general Website content or from Website unavailability, including lost profit, revenue, business, opportunity, anticipated saving or data, or indirect or consequential loss. For other claims arising solely from use of the free Website, our aggregate liability is limited to CAD $100, or the minimum amount that applicable law requires if greater. This cap does not apply to liability that cannot lawfully be limited or to services governed by a separate written agreement. For consumers, exclusions and limits apply only insofar as they are fair, transparent and enforceable under the law applicable to that consumer.

8. Governing law and disputes

Subject to any mandatory rights that apply where you live, these Terms and disputes relating solely to use of the Website are governed by the laws of Ontario and the federal laws of Canada applicable there, and the courts of Ontario have non-exclusive jurisdiction. If you are a consumer in the United Kingdom or elsewhere, this clause does not remove protections of mandatory local consumer law or any right to bring proceedings in a court that applicable law makes available to you. A separate services agreement may specify different terms for that engagement.

9. Changes and general provisions

We may update these Terms by posting a new version and effective date. The version posted when you use the Website applies to that use. Changes do not retroactively amend an existing signed engagement. If a provision is unenforceable, the remainder continues to apply to the extent lawful. Failure to enforce a provision is not a waiver. These Terms are written in English.
